1. Who may use the Service

The Service is intended for businesses — including dealerships and fleets — and their authorized personnel (“managers” and “drivers”). You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms, and “you” refers to that organization.

Tap2Fuel provides software that lets an organization share a digital team fuel card that only unlocks after a driver scans a vehicle’s VIN in the app. Managers can view fill activity, spend, and related information. Fuel is funded through your linked third-party payment or fuel-card provider account.

Tap2Fuel does not hold, transfer, or process your funds. Fueling, billing, card issuance, and settlement are handled by your third-party providers and are subject to their terms. We are not a bank, fuel retailer, or payment processor.

The Service integrates with third-party providers (for example, payment or fuel-card networks and mapping services). Your use of those services is governed by their terms and privacy policies. We are not responsible for third-party services, and their availability is not guaranteed.

6. Fees

Pricing for the Service will be described in a separate order form or subscription agreement. Unless otherwise stated, fees are exclusive of taxes. Fuel purchases themselves are charged by your provider, not by Tap2Fuel.

7. Intellectual property

The Service, including its software, design, and content, is owned by Tap2Fuel and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes. You retain ownership of the data you submit.

Our handling of personal information is described in our Privacy Policy. You are responsible for ensuring you have the right to provide any data (including driver and vehicle information) that you submit to the Service.

9. Service availability

We work to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time. VIN authorization and card unlocking depend on connectivity and third-party systems outside our control.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will prevent all misuse, fraud, or unauthorized fueling.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAP2FUEL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO TAP2FUEL FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

You agree to indemnify and hold Tap2Fuel harmless from claims, losses, and expenses arising out of your use of the Service, your data, or your violation of these Terms or applicable law.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance.

15. Governing law

The Service is available to users across the United States. Regardless of where you access it, these Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules. The exclusive venue for disputes will be the state and federal courts located in Coweta County, Georgia, and you consent to the personal jurisdiction of those courts.
